Illinois circuit judge finds FOID cards for firearms in home unconstitutional

WHITE CO., Illi. (WFIE) - White County Circuit Court Judge T. Scott Webb has found the Firearm Owners’ ID or FOID cards unconstitutional.

The ruling applies to those with guns in their homes.

The case comes from Illinois vs. Vivian Brown.

Authorities say Brown had a rifle in her home and her husband filed a complaint, accusing her of firing the gun in the home.

Police say the gun was never fired, but Brown was charged with possession without a FOID card.

Judge Webb says Brown should not have been charged and was protected by the second amendment.
